Terms and Conditions

These Terms and Conditions (the “Terms”) govern your access to and use of the Balance Spark website, mobile applications, and related services (collectively, the “Platform”). The Platform is operated by Clean Code Apps, LLC, a Florida limited liability company (“Balance Spark,” “we,” “us,” or “our”).

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.

You must be at least eighteen (18) years of age to use the Platform. By using the Platform, you represent and warrant that you meet this requirement and that you are legally capable of entering into a binding agreement.

Balance Spark is a wellness and lifestyle support platform intended to provide general educational information, habit-building tools, and wellness-related insights. The Platform is not intended to provide medical advice, diagnosis, treatment, or care of any kind.

Balance Spark does not operate as a healthcare provider, medical practice, or clinical service. Content and features available through the Platform are provided for informational and educational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment.

You are expressly advised to seek the guidance of a qualified physician or other licensed healthcare provider with any questions regarding a medical condition, symptoms, or treatment decisions. You should never disregard professional medical advice or delay seeking it because of information obtained through the Platform. In the event of a medical emergency, you should contact emergency services immediately.

Your use of the Platform does not create a physician-patient, therapist-patient, fiduciary, or other professional relationship between you and Balance Spark or any of its personnel, contractors, or affiliates.

Certain features of the Platform require the creation of an account. You agree to provide accurate, current, and complete information during registration and to keep such information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Balance Spark reserves the right to suspend or terminate accounts that violate these Terms or that pose a security or operational risk to the Platform.

Balance Spark is not a healthcare provider, health plan, or HIPAA-covered entity. Information submitted through the Platform is used solely for wellness and lifestyle support and is not regulated as protected health information under HIPAA.

You may provide information relating to your wellness interests, goals, nutrition preferences, lifestyle habits, or self-reported health focus areas. You acknowledge that Balance Spark relies on information you submit as provided and is not responsible for inaccuracies or omissions. You are solely responsible for decisions you make based on information or insights generated by the Platform.

You agree not to use the Platform in any manner that is unlawful, misleading, abusive, disruptive, or that interferes with the security or operation of the Platform. Balance Spark reserves the right to investigate and take appropriate action for violations of this provision.

All content, software, designs, trademarks, and materials made available through the Platform are owned by or licensed to Balance Spark and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes only.

The Platform may integrate or interact with third-party services. Balance Spark does not control and is not responsible for third-party services, and your use of such services is subject to the third party’s terms and policies.

The Platform is provided on an “as is” and “as available” basis. Balance Spark makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the Platform or the results obtained from its use.

To the fullest extent permitted by law, Balance Spark shall not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Platform. Balance Spark’s total liability shall not exceed the amount paid by you to Balance Spark during the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

You agree to indemnify and hold harmless Balance Spark from any claims, losses, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of applicable law.

You may discontinue use of the Platform at any time. Balance Spark reserves the right to suspend or terminate access for violations of these Terms or for operational, security, or legal reasons.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in state or federal courts located within Florida.
